1. Identification of the Provider
These Terms and Conditions ("Terms") govern the contractual relationship between you ("the Guest" or "you") and:

These Terms are published in accordance with Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE) and the General Consumer Protection Act (Real Decreto Legislativo 1/2007). By making a booking with us, you acknowledge that you have read, understood, and agreed to these Terms.
2. Scope and Nature of Services
Shanti-Som Wellbeing Retreat offers wellness retreat programmes that may include one or more of the following components: accommodation, natural therapies, spa treatments, physical activities (yoga, pilates, fitness), nutritional programmes, and additional wellness services.
Our retreat programmes are designed to promote general wellbeing. They do not constitute medical treatment, diagnosis, or healthcare services. Guests with medical conditions should consult their healthcare provider before participating in any retreat programme. Our therapists and practitioners are wellness professionals, not medical practitioners, unless specifically stated otherwise.
Where a retreat combines accommodation with transport or other tourism services, it may constitute a "package" within the meaning of Directive (EU) 2015/2302 on Package Travel. In such cases, the additional protections under that Directive shall apply, and we will provide the required Standard Information Form before booking.
3. Prices and Payments
3.1 Pricing
All prices are per person in euros and include applicable taxes (IVA) unless stated otherwise on a Shanti-Som quotation, invoice, or receipt. Prices are subject to availability and may be updated without prior notice for future bookings. The price confirmed at the time of your booking will not be altered.
3.2 Payment Terms
- Full payment is required at the time of booking to secure your reservation.
- Your booking will only be confirmed upon receipt of full payment.
- We will hold unpaid reservations for a maximum of 3 calendar days, after which the booking will be automatically released.
- Payment may be made by credit card, debit card, or bank transfer. All card payments are processed through PCI-DSS compliant payment providers.
3.3 Additional Charges
Services not included in your retreat package (such as additional spa treatments, excursions, minibar, or special dietary requests beyond the programme) will be charged separately. All additional charges will be presented to you before provision of the service and settled at check-out.
4. Bookings and Confirmation
Submitting an enquiry form does not constitute a booking. To book a retreat, you must contact us by phone, email, or through our booking system to confirm availability.
A binding contract is formed when we issue a written confirmation (by email or letter) following receipt of your full payment. Please check your confirmation carefully and notify us of any inaccuracies within 3 business days of receipt; we cannot accept liability for errors not reported within this period.
For group bookings (2 or more persons), the person making the booking is responsible for ensuring that all group members are aware of and agree to these Terms. Accurate details for each guest must be provided at the time of booking.
5. Cancellation and Refund Policy
5.1 Cancellation by the Guest
All cancellations must be submitted in writing (by email to reservations@shantisom.com). The following policy applies based on the date the written cancellation is received:

Refunds will be processed to the original payment method within 14 business days of the cancellation being confirmed.
5.2 Changes to Bookings
- Changes to the type of retreat are permitted up to 15 days before arrival, subject to availability and any price difference.
- Each booking is entitled to a maximum of 1 date change, which must be requested at least 30 days before the original arrival date. The new date must fall within 6 months of the original reservation date and is subject to availability and any applicable price changes.
- Changes requested with fewer than 15 days' notice may be treated as a cancellation and rebooking under the cancellation policy above.
5.3 Cancellation by Shanti-Som
We reserve the right to cancel or modify a booking in exceptional circumstances, including but not limited to force majeure events (see Section 11). If we cancel your booking, you will receive a full refund or, at your option, an alternative date at no additional cost.
6. Right of Withdrawal
Under the EU Consumer Rights Directive (2011/83/EU) and Article 103(l) of the Spanish General Consumer Protection Act, the right of withdrawal does not apply to contracts for the provision of accommodation services where a specific date or period of performance is specified. By confirming your booking for a specific retreat date, you acknowledge that the statutory 14-day cooling-off period does not apply.
7. Check-in, Check-out and House Rules
7.1 Arrival and Departure
- Check-in: From 15:00 on the day of arrival.
- Check-out: By 11:00 on the day of departure.
- Early check-in or late check-out may be available upon request and may incur additional charges.
7.2 House Rules
Guests are expected to behave respectfully towards other guests, staff, and the property at all times. Shanti-Som reserves the right to refuse accommodation or ask a guest to leave without refund if their behaviour is disruptive, threatening, or poses a risk to the safety and wellbeing of others.
Shanti-Som is a wellness retreat and maintains a peaceful environment. Excessive noise, smoking in non-designated areas, and the use of illicit substances are strictly prohibited.
8. Health, Safety and Wellness Disclaimer
8.1 Health Questionnaire
All guests are required to complete a health and wellness questionnaire prior to or upon arrival. This information is essential for us to provide safe and appropriate treatments and activities. By providing this information, you consent to its use for the purposes described in our Privacy Policy. Health data is classified as special category data under GDPR Article 9 and is processed solely on the basis of your explicit consent.
8.2 Participation in Activities
Participation in all activities, treatments, and programmes is voluntary and at your own risk. These include but are not limited to yoga, pilates, fitness sessions, hiking, meditation, spa treatments, hydrotherapy, and dietary programmes.
You are responsible for:
- Disclosing all relevant medical conditions, allergies, injuries, pregnancy, or medications that may affect your ability to participate safely.
- Following all safety instructions provided by our practitioners and staff.
- Ceasing any activity immediately if you feel unwell, experience pain, or believe participation may cause injury.
- Obtaining medical clearance from your own healthcare provider before participating if you have any medical conditions or concerns.
8.3 Treatment Adjustments and Refusal
Our practitioners reserve the right to modify, substitute, or decline to perform any treatment or activity if, in their professional judgement, it would be unsafe or inappropriate for you. In such cases, we will offer a suitable alternative where possible. No compensation is due for treatments modified or declined on safety grounds.
8.4 Allergies and Dietary Requirements
We accommodate a range of dietary requirements and allergies. You must inform us of any food allergies, intolerances, or dietary restrictions at the time of booking or before arrival. While we take all reasonable precautions, we cannot guarantee a completely allergen-free environment.
9. Liability
9.1 Limitation of Liability
To the fullest extent permitted by applicable law, Shanti-Som's total liability under or in connection with these Terms — whether in contract, tort (including negligence), or otherwise — shall not exceed the total amount paid by you for the booking in question.
Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable Spanish or EU law.
9.2 Third-Party Services
Shanti-Som does not accept liability for the acts, omissions, or failures of third-party service providers, including but not limited to airlines, car rental companies, transfer providers, tour operators, or any other suppliers. Where we arrange third-party services on your behalf (such as airport transfers or excursions), we act as an intermediary and the third party's own terms and conditions will apply.
9.3 Guest Property
Shanti-Som accepts no liability for loss, theft, or damage to personal property, including valuables, during your stay. We recommend using the in-room safe for valuable items. Lost property will be held for 30 days; unclaimed items will be donated or disposed of.
9.4 Late Arrivals and Missed Services
If you arrive late for scheduled transfers, treatments, or activities, you are responsible for any additional costs incurred. No refund or compensation will be provided for missed services due to late arrival.
10. Travel Insurance
We strongly recommend that all guests obtain comprehensive travel insurance that covers trip cancellation, medical expenses (including repatriation), personal liability, and loss of personal belongings. Shanti-Som is not an insurance provider and accepts no liability for losses that would have been covered by adequate travel insurance.
11. Force Majeure
Neither party shall be liable for any failure or delay in performing their obligations under these Terms where such failure or delay results from circumstances beyond the reasonable control of the affected party ("Force Majeure"). Force Majeure events include, but are not limited to:
- Pandemics, epidemics, or public health emergencies
- Government restrictions, quarantine orders, or travel bans
- Natural disasters, severe weather events, or wildfires
- Acts of terrorism, war, civil unrest, or political instability
- Strikes, industrial action, or essential service failures
- Utility failures, internet outages, or infrastructure disruption
In the event of a Force Majeure affecting your retreat, we will offer you the choice of a full credit for a future stay (valid for 12 months), an alternative date at no additional cost, or a full refund. We will notify you as soon as reasonably practicable.
12. Special Requests
Special requests (including room preferences, dietary needs, accessibility requirements, or celebration arrangements) must be communicated in writing at the time of booking. While we make every reasonable effort to accommodate special requests, they cannot be guaranteed and do not form part of the contract unless expressly confirmed by us in writing. Shanti-Som will not be liable for any claim arising from a failure to fulfil an unconfirmed special request.
13. Intellectual Property
All content on this website — including text, images, logos, graphics, videos, programme descriptions, and design elements — is the property of Shanti Som Health Retreat, S.L. or its licensors and is protected by Spanish and international intellectual property laws. You may not reproduce, distribute, modify, or use any content without prior written authorisation.
14. Data Protection
Personal data collected in connection with your booking will be processed in accordance with our Privacy Policy, Regulation (EU) 2016/679 (GDPR), and Organic Law 3/2018 (LOPDGDD). Health-related data provided in wellness questionnaires is classified as special category data under GDPR Article 9 and is processed exclusively on the basis of your explicit consent.
15. Complaints and Dispute Resolution
15.1 Internal Complaints
If you have a complaint during your stay, please raise it with our reception team immediately so that we can attempt to resolve it on-site. If you wish to submit a formal complaint after departure, please email reservations@shantisom.com within 30 days of check-out. We will acknowledge your complaint within 5 business days and aim to provide a substantive response within 30 days.
15.2 Alternative Dispute Resolution
In accordance with EU Directive 2013/11/EU on Alternative Dispute Resolution (ADR), we inform you that in the event of a dispute that cannot be resolved directly, you may submit a complaint to the consumer arbitration board of the Junta de Andalucía (Junta Arbitral de Consumo de Andalucía) or the Spanish consumer protection authority (Dirección General de Consumo).
15.3 Consumer Rights
Nothing in these Terms shall affect your statutory rights as a consumer under applicable Spanish and EU consumer protection legislation. Where any provision of these Terms conflicts with mandatory consumer protection law, the consumer protection law shall prevail.
16. Applicable Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Spain. For consumers, the competent courts shall be those of the consumer's place of domicile, as mandated by EU consumer protection regulations. For non-consumer disputes, the courts of Málaga, Spain shall have exclusive jurisdiction.
17. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a competent court, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that achieves, to the greatest extent possible, the original commercial intent.
18. Amendments
We reserve the right to update these Terms at any time. Changes will be published on this page with an updated "Last updated" date. The Terms in effect at the time of your booking confirmation shall apply to your reservation.
